2. Scope of Service

Scaptra Engage includes:

Configuration and deployment of an AI chat widget

Ongoing operation of the widget while subscription is active

Lead capture and delivery to customer-designated channels

Platform maintenance and improvements

Scaptra AI does not guarantee:

A specific number of leads

Conversion rates or sales outcomes

Suitability for every industry or use case

The Service is a tool, not a replacement for human judgment or sales processes.


3. Onboarding & Setup

Setup begins only after payment and onboarding form submission

Customers must provide accurate and complete onboarding information

Delays in providing required information may delay setup

Setup and configuration fees are non-refundable once work has begun


4. Subscriptions & Billing

Scaptra Engage is billed as a monthly subscription

A one-time setup fee may apply at initial purchase

Payments are processed securely via Stripe

Subscription fees are billed in advance on a recurring basis

Cancellation

You may cancel your subscription at any time

Cancellation takes effect at the end of the current billing period

No partial refunds are provided for unused time


5. Refund Policy

Setup fees are non-refundable once configuration begins

Subscription fees are non-refundable

Refunds are not provided for dissatisfaction, lack of leads, or changes in business circumstances


6. Acceptable Use

You agree not to use Scaptra AI to:

Collect unlawful, deceptive, or misleading information

Violate privacy, data protection, or consumer laws

Harass, defraud, or misrepresent your business

Deploy the Service in regulated or high-risk use cases without appropriate compliance

You are solely responsible for how you use captured lead data.


7. Customer Responsibilities

You are responsible for:

Compliance with local laws and regulations

Providing accurate business information

Managing and responding to leads

Ensuring your website and use case are lawful

Scaptra AI is not responsible for customer misuse of the Service.


8. AI Limitations & Disclaimer

Scaptra Engage uses automated and AI-driven systems.
You acknowledge that:

AI responses may not be perfect

AI-generated content should not be relied upon as legal, financial, or professional advice

Scaptra AI is not liable for decisions made based on AI output


9. Service Availability

We aim to provide reliable service but do not guarantee:

Continuous uptime

Error-free operation

Maintenance, updates, or outages may occur from time to time.


10. Intellectual Property

All software, branding, and platform components remain the property of Scaptra AI.

You are granted a limited, non-transferable license to use the Service while your subscription is active.


11. Limitation of Liability

To the maximum extent permitted by law:

Scaptra AI is not liable for indirect, incidental, or consequential damages

Total liability is limited to the fees paid by you in the preceding 3 months


12. Termination

We may suspend or terminate access if:

These Terms are violated

Payments fail or are reversed

The Service is used unlawfully or abusively
